What is agentic litigation?

Agentic litigation is litigation work carried out by software that acts on a case without being asked, under the review and judgment of a lawyer.

The difference is who starts the work

Most legal AI is a tool. A lawyer opens it, types a question, and reads the answer. The lawyer still decides what to research, reads the cases, builds the outline, writes the brief, and checks the citations. The tool makes each of those steps faster. It does not take any of them.

Turn that around, and the work starts when the case moves. When the other side files a motion, your swarm takes those steps off the lawyer, all of them, without being asked. For an ordinary opposition to a motion to dismiss, that takes an hour or less. The lawyer receives a finished draft.

What the lawyer does

The lawyer reviews. The lawyer decides what the firm will argue, changes what needs changing, and signs. Nothing is filed without the lawyer. What changes is where the lawyer’s hours go: away from producing the brief and toward judgment, strategy, and the client.

Why it matters to plaintiff-side firms

A plaintiff-side firm’s capacity is set by lawyer time. Every motion the other side files claims days of it. When most of that work moves off the lawyer’s desk, each motion costs the firm hours instead of days. The firm can carry more cases, and the other side’s motions stop consuming the time they used to.
